2. Acceptance of Terms

Use of this website for general information purposes does not in itself constitute acceptance of these Terms and Conditions in relation to legal services.
3. Description of Services
Mata Pusaka provides pension protection legal services in Malaysia, specifically:
- Pension Records Reading Session (RM 330): A single session of up to 90 minutes in which a qualified lawyer reads pension and KWSP statements with the client. Concludes with a one-page written summary.
- Pension Reduction or Suspension Review (RM 720): Legal review, correspondence with the responsible authority, and written advisory note for retirees whose pension has been reduced or suspended.
- Long-Standing Family Pension Plan (RM 970): A long-form engagement covering wills, EPF nominations, hibah arrangements, and a written family memorandum.
Services are available to individuals resident in Malaysia. Geographic restrictions may apply to formal authority correspondence for clients residing outside Peninsular Malaysia.
4. Engagement and Commencement
A legal engagement with Mata Pusaka formally commences upon the signing of an engagement letter and payment of the applicable fee. Prior conversations, enquiries, and initial consultations do not constitute a formal legal engagement and do not create a solicitor-client relationship.
We reserve the right to decline to act in any matter at our discretion, in which case any fee paid for a service not yet commenced will be refunded in full.
5. Client Responsibilities
You agree to provide accurate and complete information relevant to your matter. Knowingly providing false or misleading information to a legal practitioner is a serious matter under Malaysian law and may result in the termination of your engagement without refund.
You are responsible for maintaining the confidentiality of any written summaries, advisory notes, or family memoranda produced in the course of your engagement. These documents are intended for your personal and family use and should not be reproduced commercially.
6. Fees and Payment
Fees for each service are fixed and communicated in full before commencement. All amounts are in Malaysian Ringgit (MYR) and are inclusive of any applicable taxes.
Payment is required prior to or at the time of the session for the Pension Records Reading Session. For the Pension Reduction Review and Family Pension Plan, payment terms are outlined in the engagement letter. We accept bank transfer and cash. We do not accept payment by cheque.
If the scope of a matter changes materially after commencement, we will discuss and agree any revised fee with you before proceeding.
7. Refund Policy
For the Pension Records Reading Session: If you cancel with at least 48 hours' notice, a full refund will be issued. Cancellations with less than 48 hours' notice will incur a 50% cancellation fee.
For the Pension Reduction Review and Family Pension Plan: Fees paid for work already completed are non-refundable. If you choose to discontinue before completion, you will be charged only for work performed to that point, and any balance will be refunded within 14 working days.
8. Intellectual Property
All content on this website — including text, structure, and design — is the intellectual property of Mata Pusaka and may not be reproduced without written permission. Written summaries, advisory notes, and family memoranda produced for a client are provided for that client's personal use only.
9. Disclaimers
The information provided on this website is for general informational purposes only and does not constitute legal advice. It does not create a solicitor-client relationship. Each individual's legal situation is different, and you should obtain specific legal advice for your own circumstances.
Mata Pusaka does not make any representation about the outcome of any legal matter. Written advisory notes describe realistic options, not results.
10. Limitation of Liability
To the extent permitted by Malaysian law, our liability in connection with any service is limited to the fee paid for that service. We are not liable for indirect or consequential losses arising from decisions you make on the basis of our advice.
11. Termination
Either party may terminate a formal engagement by written notice. We may terminate if you provide false information, fail to meet payment obligations, or if a conflict of interest arises. Upon termination, you will receive copies of all documents in your file and a refund of any unearned fees.
12. Governing Law and Disputes
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from or in connection with your engagement with Mata Pusaka shall first be referred to informal resolution by written communication. If unresolved within 30 days, the matter may be referred to the Malaysian Bar Council's Complaints Committee or to the courts of Malaysia.
13. Changes to These Terms
We may update these Terms from time to time. Changes will be published on this page with a revised effective date. Continued use of our services following any change constitutes acceptance of the updated Terms. For ongoing engagements, material changes will be communicated directly to you.
